School bus with flashing red lights in Québec: what do you do?
One of the strictest rules in the Code: the offence carries 9 demerit points.
Short answer: as soon as a school bus’s flashing red lights are on or its stop arm is out, stop more than 5 metres from the bus. Only move again once the lights are off, the stop arm is folded back and it is safe. This applies whether you are behind the bus or coming toward it, unless a median or another raised barrier separates the two roadways.
Two signals, two responses
| What the bus does | What you do |
|---|---|
| Alternating yellow warning lights (or hazard lights) | Get ready to stop: the bus is about to pull up (Guide de la route, ch. 4). |
| Flashing red lights or stop arm out | Come to a full stop more than 5 m from the bus (Code de la sécurité routière [Highway Safety Code], s. 460). |
| Red lights off and stop arm folded | Move on after making sure it is safe (s. 460). |
When do you have to stop?
The law forbids meeting or passing the bus while the signals are on. That covers drivers following the bus and drivers coming from the other direction, and it applies to cyclists too (Code de la sécurité routière, s. 460). According to the SAAQ handbook, it doesn’t matter where the bus is on the same road, ahead of you or on a crossing road.
| Your position | Must you stop? |
|---|---|
| Behind the bus, same direction | Yes |
| Oncoming, on a road with no physical separation | Yes |
| Oncoming, on a roadway separated by a median or another raised physical barrier | No (s. 460, second paragraph), but stay careful |
Painted lines are not a median: on a road where the two directions are separated only by lines, you stop.
When does the bus turn on its red lights?
The bus driver must switch them on and extend the stop arm when stopping to let people on or off, and keep them on until those people are safe (s. 456). When several school buses are stopped in a row, the ones behind also turn on their signals (s. 457). These rules apply at all times to buses normally used for school transport when they carry people under 18 (s. 461).
The sign that warns you
When a curve or a hill hides a stopped bus, a “school bus stop ahead” warning sign may tell you one could be there. Slow down and be ready to stop (Guide de la route, ch. 3, “Signal avancé d’arrêt d’autobus scolaires”).
Consequences
Failing to obey a school bus’s lights or stop arm carries 9 demerit points (Règlement sur les points d’inaptitude, the demerit points regulation, schedule, item 27), plus a fine. That is more than the 4-point limit for learner and probationary drivers, and more than the 8-point limit for licence holders under 23 (same regulation, ss. 5 and 5.1): a single offence is enough to have their licence revoked.
